On my Surface Pro 3, the touchpad still works with the type cover flipped back. How can I fix this?

This didn't happen on my SP2... It's very annoying as the touchpad is in the perfect place to hold the Surface (in portrait mode), so I always end up making inadvertent mouse clicks when reading. The keys all are disabled, but not the touchpad...
What gives? Any way to fix this?

Not sure how to fix it, but it doesn't happen with mine as I just tested.

Has it always been like this?
