I have a new nokia 1020 with windows 8. It is January of 2017 and I cannot find where to download windows phone 8.1

Do you mean you are trying to upgrade your phone from Windows Phone 8 to Windows Phone 8.1? The update should be available via phone update. If you don't get it that way, you should try to download the latest image using Windows Device Recovery Tool.
