Why can't we just buy a blank device and let these guys set it up?

I suspect that the version of WP8 running on the HD 2 is technically pirated, so that's one reason it cannot be done by a third party.

Although, it does reveal Microsoft's claim that WP7 handsets cannot run WP8, when most of them are more powerful than the HD 2, to be a bit suspect.

This isn't entirely true, supposedly the only thing that works is the start screen and nothing else.

It's obviously not impossible. However, the HD2 can't run WP8 properly and it can only boot off the SD card, internal storage does not work.
