If you have the game just pop it in and download the updates for it and you are good to go.

I had the same problem until I turned off my internal speakers in the tv. Check your TV settings and see if it gives you the same option.

I would either take it back and exchange it for another or send it in for repairs. It shouldn't be making any noise, mine is whisper quiet after hours of gaming.
