Firmware is distributed by the carrier. Being unlocked/unbranded means nothing by itself. If you download the carriers firmware that has the feature you'll get that feature. If you download another carriers firmware, you won't. Understand?

Not quite correct. I have an RM-940 unlocked that I use on T-Mobile. You get LTE, 4G and then drop down to Edge. (4G is only HSPA+21 vice HSPA+42, assuming the towers have been refarmed. I believe T-Mo has said they are nearly done regarding too or will be done by the end of this year, so...

I have an unlocked AT&T branded 1020 that works perfectly fine on T-Mobile. It can get Edge, 3G (HSPA+21) and LTE. As long as the towers near you have been refarmed, you can do this and get LTE. I've done this with a Lumia 1020 and 1520.

Use the WiFi toggle? If WiFi is off you are on data. That's how I toggle between WiFi and data via action center.

For those in the USA, I wouldn't expect an update any time in the near future. Carriers will likely take months to approve Cyan. In AT&T's case, it may be 2015 before you get the update.
