My LLC created a third-party application that we're in the process of publishing to the Windows store. The app interacts with a closed/undocumented API that was revealed by man-in-the-middle methods - observing the network traffic between their app and the internet. No disassembling or decompiling was used, therefore no source code exists in our version.


A few months ago, i tried multiple times to contact the company that created the iOS and Android apps in order to solicit free development of a version for Windows. They did not respond to any emails.


There is also no valid trademark or copyright on the name of the app. There was a dead/abandoned service-trademark that expired in July 2016, with a note that.
"This trademark application was refused, dismissed, or invalidated by the Office and this application is no longer active"

I've read the EFF.org's article but still have a little doubt.


How did Rudy Huyn get around this stuff?
