Writing this on my HTC One, my Ativ S is currently updating to GDR2 here in Switzerland.

Ok, update complete. Just a OS update, adds no features. However my phone got faster. <- Ativ S.

If it's unbranded and unlocked then you need to do a factory reset to get data sense

Not going to reset, the Ativ S is my spare phone and the 1Gb a month plan I have is fine as I do most over WiFi. Also all my high scores... I want to keep those!

Well that's up to you but it doesn't change the fact that Data Sense is included in the update.
