Gchat clone in marketplace

I've been using an app for google chat called "gchat" that works pretty well. I noticed on wmpoweruser.com that a new app called google talk was available, so I gave it a shot. It is absolutely identical to gchat except for the name and tile. Are apps covered from this type of piracy?
