MacPherson represents a type of case under *common law* of contracts where privity is not required -- a products liability case. This is because the actual defect in manufacturing can occur with any of the parties involved and not the party selling the product. To only make the seller liable would insulate all others from liability and wouldn't feel "right" in order to maintain our sense of economic equilibrium.In general you are correct but that is because much law has been codified. I'm not sure if our friend Scary has a legal code that he can point to which will give him a right of action.

Obviously, if you are able to get anything on his true Identity....even possibly an email account through his ISP (which would have his billing information that can usually be obtained by law enforcement), then law enforcement might be able to help. 20 phone x $600 = $12,000 fraud case against Sprint and then add an additional $400 x 20 = $8,000 for selling them on eBay. That is a $20,000 fraud case. The local publicity catching someone in a $20,000 eBay fraud case might be motivation enough for a police dept in that guy's local area to actually help you out.
I have seen a several posts over the years where they got the bad guy's local cops to bust him over eBay scams.

Please report this to the California State Attorney. Ebay is the biggest fence in probably the world and their response is constantly that we can't do anything about it-we don't know anything about it! But if this happened in any other place, they would be shut down in a second.
I'm sorry, I didn't catch the original post ref. what happened. I am a police officer in charge of computer crimes at a police agency in Michigan. How long had the suspect been an ebay member? Presently, a credit card is required to open and verify a new ebay account. If the suspect became a member within the last year or so then you have a pretty good chance of obtaining his identity via a search warrant for ebay.....assuming that the credit card used to register was not stolen. If it was an older account then it could have been opened before the credit card registry requirement began. If this is the case then the chances of finding this guy/gal out is minimal. How was payment made? Again, if it was a money order then it doesn't look good. Given the amount stated above I suspect that it was not. In a nut shell, because most of these cases involve multiple jurisdictions.....the best bet is to go with the FBI since they have national jurisdiction and resources to handle this kind of crime. If you have a good email address, not hotmail or other anonymous accounts, then their service provider can be found with minimal effort and then a search warrant serviced on that provider for subscriber information. It shows he was registered at Ebay just under 2 years. I have a name, Lloyd Franklin, and a disconnected phone number to Pine Bluff, Arkansas. His email is from Hotmail. So not a lot of help there.
I do not have the particulars of the indentity theft. I don't know for instance if this guy hijacked someone else's Ebay account to do this, or used his own.

What PO'd me about the situation was the seller list the Treo's one at a time for $400 Buy it Now, I bought the first, then saw he had sold six more in the next few hour. Smelling a scam, I immediately notified eBay and PayPay requesting the fund be frozen in the sellers account, explaining in detail why I suspect fraud.
Needless to say, 3 days later I got a response from eBay and PayPal telling me that they could not freeze the funds as the seller had already withdrawn them.
After 7 years on eBay, I seriously doubt that I will ever buy anything there again and if I do, you can bet it will only be with a credit card so that I can file a charge back on PayPaly within 30 days.

I think a good rule of thumb would be to NEVER send a Western Union. I almost got scammed out of a grand that way...

worst part about this story is that it happens hundreds and hundreds of times EVERY DAY. every time i post something i get 10+ emails from people in Nigeria with some crazy story why i need to ship it there for their son or daughter and they will pay me with US money order...its a shame...
Absolutley TRUE!!! I was scammed by an eBay seller over a year ago for a Treo 650. He listed it as brand new unopened box that he had gotten as upgrade but didn't need, only one.
LOL, I bought it with BIN for $400 includung shipping. 10 minutes later he listed another using the same add, sold it right away. Over the course of 8 hours he sold 19, one at a time using that ad. After he had sold the 3rd, I contacted eBay and Paypal of suspected fraud, took them 3 days to get back to me and their response was that he had already withdrawn the money from Paypal, so they could not freeze the account.
Whenever I have withdrawn money from Paypal it took me 3 days to get it from them.
Anyway, under PayPal fraud protection (joke), I got $200 back, actually $175 after PayPal's $25 processing fee was deducted. Having sold and bought on eBay for 7 years, that was my last transaction on eBay!

One of the things I ALWAYS do when buying anything over $50, is check their rating. I know this is isn't full proof any means, but it sure does help weed out some of the rift raft in eBay. For example I just bought a couple Wii games (high potential for fraud) I ignored anyone with under 800 or 1000 feedbacks and who did not have 99% or higher positive feedback. I also double check if they are feed back from selling and not just for buying.

800 or 900 hobbes? holy ! I guess when I sel this 6700 my rating of 100% for only 8 items won't do you any good ps I know you are looking for a 6800 so not to worry. but 800 or 900 is quite high! I usually find those high power sellers sell at a higher price, and usually have someone "boost" their auction to get more $$. good thing I didn't have any complaints after selling 2 blackberries, 2 treos and Imate JasJar.
ps I should have held on to the jasjar especially with 3.5 aku.
pps we can continue this conversation privately but are you still holding onto your 6600? have you at least a evdo rev a broadband card? if so I highly do NOT recommend the novatel u720 unless you have a mac. I've tried all the evdo rev a and the best by far (and for the money) is merlin s720. and you can plug it into a kr1 router or linksys (i forget model #) and have wifi anywhere, anyplace! I just did this is my house since I had aguilty conscience at stealing my neighbors wifi.

Actually....I have historically done rather well with filtering eBay with power sellers. There are always exceptions and I certainly trust my gut and throw out my own rules at times. What makes this a great rule of thumb while still getting good prices is Auction Sniper. If I am looking for an item, I will find up to 40 auctions of the item by power sellers with 99-100% positive feedback from selling and put them all in a GROUP with a max price I am willing to go. I set this price lower than I would realistically think I could get the item for. The sniper then places my bid the last 3 seconds of the auction. I will loose 39 of the auctions but get that one that ended at the worst time in the morning when no one was up bidding. Once I win an auction the eBay Sniper then cancels monitoring and bidding on all the other auctions in that group to make sure I do not win multiple auctions. Works wonders and has saved me hundreds of dollars. For example I just bought a popular sealed Wii game that retails for $50, going on eBay for an average of $65....for only $23 with shipping. I just did this with my new N router 2 weeks ago too. Saved at least $200 retail and about $100 off of the average eBay prices for the router, laptop card, and PC card.
Yup....I skipped the 6700 and hanging tight with my 6600 until may for the 6800. Sprint's broken promise to enable the EVDO that is in the 6600 is my only complaint with the phone.

If I did, I would seriously look at a router that will take the Rev A card....except then I would have to buy two cards so that my family would still have internet while I am on the road. I have been trying to talk my company to spring for the card and the account....but no luck so far.

as for sprint- i had such a horrible problem with them over my 6601, my business partner still has his, mine literally DIED on me and because i didn't sign up for the insurance within 30 activation days (i was of course told i could sign up within 90 days at the store) i couldnt throw my 6601 against the wall! however...
when i called to renew in the summer (my 2 year renewment was up in nov) i tried to get 2 6700s for $150 each - i was going to renew both lines for 2 years, and i had it all set in motion but the customer service rep said she was going to have to call me back to get the activation and shipping override from her supervisor. of course she never called back, i waited over a week getting steamed (i kept getting calls from Sprint in the evening but it turned out to be a satisfaction survey!) and finally really thought about going to cingular because of the expected hsdpa arrival. then when i went into purchase a broadband card from the local store, the guy there said he had a few preowneded 6700s for $300... very tempting. but i HAD to renew my contract (but it did NOT have to be up, or at the end of 2 years, it could be 6 months into the contract, as long as i renewed it for another 2 years). i got a good idea, called sprint, complained about the 6600 evdo fiasco, they offered the 6700 for $449. i said, you know what, give me $200 rebate and i'll just buy one at the store. they said as soon as we see you've renewed your contract, we'll give you $200 in credits. so i walked into sprint, got the 6700 for $320 after tax, later that evening called sprint and they credited my account $200. now that might not be as good as your ebay sniper story but!!!)) not to mention, ever since the release of AKU 3.3 for the 6700 (unofficial release of course, they are working on 3.5 right now) i really dont even SEE myself upgrading to the 6800. the only thing i was really looking forward to was 3.5 or crossbow on the 6800, and more memory! that was my #1 concern, because with the earlier AKUs, i only had about 6-10megs left at any given time (and believe me, surfing with evdo eats that up QUICK!) but now i've got 28megs of caching available and that's AFTER all my programs are installed. plus i dont want to lose my tethering. i barely EVER use it, but it has come in handy when my office cable has gone down temporarily. not to mention the "upgrade" to microsd - i'm not looking forward to that.
i should tell you a few ppl found a SDHC.dll in the AKU3.3 rom, they are trying to figure out if the 6700s can use the high capacity SD cards! that would make the 6700 even more worthwhile...
but as for the routers - the s720 is the only card REALLY officially supported, the novatel u720 USB does work on the KR-1 but not officially.

OT: Good deal! If I had the 6700 I would probably skip the 6800....but moving from a 6600 to a 6800 is a no brainer and voice & data at the same time sure will be nice!

sign into your accont and click the "contact us" link, then send an email complaining. I also forgot to mention - if you send it on a friday or saturday, they respond within 24 hours from their outsourcing department! I advise you to write after 8pm, in hopes of getting someone who is more easily "understanding" of your situation and any problems sprint has caused. I wrote on a friday night and by sunday 11am I had a $267 credit. I should also mention you MUST DEMAND , not ask. I have 3 lines 1 broadband yet my bill is over $211 a month. with the amount of business I've given sprint, let alone money, the least they could do was compensate me. so demand compensation!
pps write out your letter on your desktop and copy and paste in the sprint window, it times out after 5 min and if you aren't done typing you lose all your info. there is also a character limit
