Voice activation over Bluetooth requires phone to be unlocked

When I'm cycling along with my Bluetooth earphones I am able to issue voice commands to my phone - by pressing the play key for a couple of seconds the phone will respond with the "Listening..." tone; I can issue commands like "Play some music" and the phone responds with "OK, you just need to unlock your phone first".
Grr! That's exactly what I shouldn't have to do when I'm issuing a voice command . Is there a setting - short of disabling the phone security - that allows this to work?
