Sorted this myself..although it is listed as an upgradble phone the upgrade advisor says it is'nt.
I did try the insider option which only worked the second time I tried hence this post after my first try.
This experience is probably why windows phones are being held back.
Lack of apps and sloooooooooooooooooooooooooooooow upgrade problems gives windows phones a bad name.

And another thing ............I filled a form in online regarding my problem and got the call back option, on the form I stated Windows PHONE and short decription of problem and behold Microsoft rang me and I then decribed my problem .........."oh we don't deal with that in this department ......ring *************** number."BUT they rang me .................. unbelievable.
