Why can't I activate or even reserve my Windows 10 (no Windows button)?

My problem is a very usual one connected to Windows 10, I have a new laptop which is very good in terms of components and it has Windows 8.1. I have updated all the windows updates I could and yet I don't have the Windows button. I've looked through other posts but I can't seem to find a definitive answer and solution.
Could someone please help?
