There is almost no feedback on this but it appears to be a major usability problem. If you have a fixed sized application active in tablet mode, accidentally touching or bumping the exposed desktop will cause the start menu to load. Imagine using a pen in this situation!
Being a tablet it should treat these windows as if they were still full screen and not allow the desktop to take focus.
