I love my Band 2, but Microsoft has a serious manufacturing problem with this device and its battery housing. It makes the device seem to not take charge, and eventually it will just get to the point to where it won't work without being plugged in. I bought my first Band 2 from the Microsoft Store (online) but I work out so often I went to Best Buy and bought one from there and just returned the one from the Microsoft Store. I really hope Best Buy doesn't try to stick it to me on this and not swap out my band, it should be covered by the manufacturer warranty. I'm sure the next Band 2 I get (if Best Buy cooperates tomorrow) will be a ticking time bomb too. I really wish Microsoft would come out publicly and acknowledge this manufacturing defect. This one lasted longer than my first Band 2 did, but it eventually died from the same fate.
It is absolutely a hardware problem too, maybe a bad solder for the battery? I don't know, but it's definitely battery housing related. No software update will be able to address this. It's time for Microsoft to own up. As you can see just in this forum several people are complaining about it. I had hoped it was just one lot that had the issue, but my two Bands that have died were definitely not from the same lot.
