Games with Gold, Xbox360 on Xbox One problems

I'm getting the following message when I try to purchase Crysis3

"Is this your first purchase? To ensure it is compatible, please sign in to Xbox Live using your console and try again."

I've never owned a Xbox360, however I've managed to 'buy' the last couple of Xbox360 Games with Gold titles. So, my question is: Is anybody else seeing this message?

You need the game disc in order to 'purchase' (which is free).
