Home button won't power on / off or sleep / wake

So I just bought this and everything seems to be working except I can't power it off and on or locking and unlocking it ( I press long enough ). When it's turned on by the charger the home button seems to be working. Any idea as to whats the problem before I return it?

I have had this phone for about 7 months and just started experiencing the same issue on the 25th. I can regain the use of the power/lock button by resetting the phone. I have done this 3 times now (it only seems to last about 24-hrs). Therefore, I don't think it's a hardware problem but more likely a software issue. Haven't yet found a good fix.
