i hard resetted my phone and now i can not download app because i need to have family set up

You only need a family set up if you are "too" young. So if you made a mistake in your birthdate when you made your MS account then login in on outlook.com and change you birthdate otherwise you indeed need a adult account to approve the apps you want to download.
