Well, at least for file transfers running over HTTP, doing so in the background has been possible ever since WP7.1 (see this). Why more apps don't use that feature I don't know. We've all seen it in action when downloading apps from the store. I often feel the whole "WP has restrictions blah blah" mantra has become ridiculously overused at this point. Once that was true, but now I think a lot of developers are just using it to excuse themselves from doing their job properly, primarily because it's an easy sell. Sure, MS can still make some improvements, but it's rarely a valid excuse these days, particularly for the type of things discussed in these forums.

With WP8.1 the OS now supports the same background file transfer facilities as WinRT (see this, or this if you just want to read about the differences to earlier versions of WP). I don't know if that sort of convergence will get more developers to use the OS features available to them, but it's ultimately up to them to do so.

Anyway, I agree that many of the apps still feel like they are a generation behind. However, I disagree with you that this is the fault of the OS. At least most of the time, it's the apps themselves.
 
Because they want WP to be great, and not blunder around with what should be simple issues like Xbox Music that isn't worse than WP7's Zune. People are hard on WP when it fails to meet its potential. But it will take more than that to make me go back to some icon grid. There are a LOT of reasons to prefer another platform, and WP's flaws are some of them. But there are more compelling reasons to stick with WP for those of us who choose to do so, even if we feel MS could be doing a better job making our choice even more rewarding.

Personally, I'm pretty happy with WP, and just wish Audible would fix their app already. 99% of my headaches as a result of being a WP user are Audible's fault. The other thing WP needs is for Lumias to stop releasing downgrade-y upgrades. If my last phone had feature X, then my upgrade should too. So far the only strict upgrade up from my 920 is the 928 (better flash) and the 1520.3. Every other Lumia forgot something.
