I bought a refurbished unit and had touch problems within a few weeks. Returned for repair and have had no problems since.
Believe it to be a hardware issue but don't know for sure what was replaced on my phone.
I suggest sending it for repair.

Who did you return it to? Nokia care or to the seller? I checked my imei on the ms website and they told me that I'm out of my warranty period even though my phone is 8 months old from the fabrication date.

Same problem here. I have it checked in a service center but the transition of Lumia from Nokia to Microsoft has resulted to crappy services. After a lot of complaining, the service center replaced the entire display assembly, since unit is still under warranty.

This problem sounds like the phantom touch issue, which is caused by the phone being flexed causing the digitizer to get out of sync, its remediable, BUT, if you can, return it ASAP as it means there was in fact damage done to it at some point! also, invest in a case for it and don't keep it in your pocket when you'll be running around/lifting heavy stuff a lot (just general tips to prevent from flexing it)
