Microsoft does have right to use that brand for next 10 years if the acquisition goes through. Nokia owns the brand but licensed to Microsoft.

They can only use the Nokia brand in dumb and feature phones, not in smartphones.

Could be, but I also wouldn't be surprised if Microsoft was behind it the whole time. Maybe they told Nokia to release it before the changeover to save face. Who knows? This is a million customers that will be using Microsoft's services that likely would've otherwise bought another Android.
