Why is my Nokia 521 phone unable to check for updates?

Nokia 521 phone unable to check for update

I have WP8, I cannot get 8.1 because of this issue.. I'm on WIFI, battery saver is off and location is on.

It just sits there saying "Checking for update..." for several minutes, then that changes to "Your phone is up to date, last checked about 9 months ago."
