Qualcomm worked with Nokia for it. The snapdragon series (only some) are the hardware component, and Nokia's software part is the software component. Did I ever say it was open source? No, I don't believe I did. So are you really asking why non-MS phones don't have it? Did we not just discuss that Microsoft can provide it, just like the Nokia camera, that these other phones also do not have? All MS has to do is add the software portion to the OS for everyone, I suspect they will. It makes little sense for them not to, because it is a very useful API for WP.
