Odst. I have MCC. But have not been prompted to download ODST. xbox was bout early Dec last year. Should I not get it for free? Or is it a case that because it was not connected to xbox live until Christmas that its not deemed to be in use after the cut off?

No its not, also you said you get your Xbox in early Dec which is already past the date. If you're upset with this then contact Microsoft support.
