Menu issue on some apps - swipe up does not bring up menu if there is an app menu

I am having an issue with this phone with some apps where if I swipe up the "Windows" menu does not show up. This is very annoying is there a way to fix this? If you want to try to recreate the problem, download the game "Flow" and start play. This seems to happen whenever the app (game) has a menu of its own at the bottom of the screen.

If you open Flow and select a single game the swipe up for menu works fine until you get to a screen with an application menu at the bottom - the game itself. Other games I've noticed this with are "Words With Friends" and "Word Feud". I'm new enough with the phone that I don't know if this is going to be a pervasive problem or if there is a fix.
