Windows Button Locks on occasion

Perhaps, this is a hardware issue. When some apps are active, the Windows button is inactive (dead). Sometimes, if I touch the screen, it will activate, but other times I have to swipe the app away to get the button to work.

Anyone else seeing this?

My windows button also doesn't really respond. I just use the charms one.
