Help with new phone downloading apps

Just received a new lumia 1520 and I am trying to set it up to get it to download apps. apparently windows requires you to set a my family before you can download anything. Went to the windows phone website and tried to access the 'my family' tab to see what needed to be done. Apparently i need to agree to the terms and conditions of the phone store but everytime i try to click accept it gives me this error." Internal server error
Something happened, and we can't get to the page you want at the moment. Try again in a little while." i still cant download apps anyone with suggestions?

This may seem stupid but do you have a Microsoft account?

It doesn't require anything apart creating/log in MS account

yea i do. under "my phone" i see that my phone is synced
