Replaced Phone, can't get Amber or Black

My old 928 took the tumble and has been replaced by another one that was sitting in my son's drawer for 6 months or so (he gave it a try anyway). I have run update several times and the OS is up to date but it still has a pre-Amber Nokia package on it. How can I get the phone to upgrade the Nokia software? Thanks!
