You might want to check AT&T Mobility LLC v. Concepcion, 563 U.S. 321 (2011). I haven't read (or Shepardized) it recently. But, sadly, I believe AT&T won that one.
Of course they won. That's why AT&T can tell me to cram it and then tell the BBB that the case has been "settled". And then the BBB folds. :unhappy:

While there is a certain logic to that, it also doesn't make sense. That only works for the subset that just outright buys phones whenever they feel like it. Under a contract, or even under the shortest Next plan, the 830 isn't eligible to be traded in/replaced yet.

some enterprise plans can :) until recently, i was eligible to upgrade every 8 months.

The point still stands, my wife's 830 isn't even close to the halfway mark of being paid off. For example right now I can't decide between paying the entire phone off and sticking with it, or paying off only the portion that gets me to an upgrade and jumping her to another phone. The denim/windows 10 release is a big factor in that decision since she uses the camera a ton.

Just a quick update...

I finally received my determination from AT&TY regarding my BBB complaint. The woman I dealt with from the Office of the President definitely did her due diligence on this and confirmed that AT&T is in the Testing Process with Microsoft on Full Denim update. She did not have an ETA but said she was told ASAP. But she couldn't get a further definition from the team.

Informed her that Microsoft resolved my issue with an unlocked version of the 830 and she was shocked but grateful.

She also mentioned that AT&T is gearing up to release WIFI calling but didn't know on what devices.

Nope, especially since AT&T has been giving mixed answers. Hopefully the last 2 answers from AT&T are accurate (that the update is indeed coming)

Pressure may have forced this... Full Denim must have been in their (ATT) hands quite a few months now. There is no major hardware variance with RM-983 from other Lumia 830 models. Any fault must be in the ATT additions to the firmware, but they are old hands at adding their Apps and tweaks to WP. I would presume the OTA was resurrected from the dead sooner than believe that there is some Herculean task needed to get full Denim running on RM-983.

Agreed. It was probably in the "not that important, so who cares about it" pile until they started to get BBB complaints and then someone was crazy enough to go the arbitration route... Considering no other "recent" Windows Phone on AT&T is pending an update until Windows 10 to my knowledge, they should just get it out. Even if they don't want to push update 2, at least push the bloody firmware out.

Is anyone else nervous about buying expensive new phones from AT&T due to this situation? I always had a warm fuzzy feeling from then in the past re updates, but this whole issue has really soured me on them. I suppose the only other alternative is to buy completely unlocked... I really think they've handled this situation in the worst way possible. If you agree to release it, you should agree to support it.

Yes, not just nervous but convinced that I will not buy from ATT again. They can offer the new phones for 99 cents on a 2yr contract and I still wouldn't touch that deal.

Well lower-tier AT&T support changed their tune on me again. Now it's "we have no information" and "talk to Microsoft" once again, while Microsoft says "talk to AT&T, it's in their hands". Though MS chat support told me to call them up... I'll be surprised if anything good comes of it, but I'll report back if so.

Tier 1 support is usually only good for the same info a google search will find.

I am a Lumia 830 owner and a long time lurker on this site and just now registered. I too am not happy about this whole update thing and decided to contact AT$T myself. I was able to talk to a top tier technical support person and this person seemed to be in the loop and knew exactly what I was talking about. This is what he told me. He told me that AT$T never was able to fully "optimize" the update for their network, he went on to say that they will be bundling the Denim update with Windows 10 around November. He said over and over again to me that they are not giving up on this phone and are fully supporting it. I have no idea if this is true or not, I personally am not holding my breath but though I would share. Has anyone else been told this info?
